At Efforia, we understand that your privacy is important to you. Inspired by the Electronic Frontier Foundation, we, at Efforia, believe data privacy is a human right.  We are committed to protecting your data and providing you with a secure platform for authoring and participating in challenges. 

This Privacy Policy explains how we collect, use, and protect your data, and your rights as a data subject.

When and if we become aware of hate speech or if you suggest you will harm yourself or others, it is important you understand Efforia will refer these issues to local law enforcement. Hate speech is a crime. Similarly, if someone is exhibiting signs of suicidality or a wish to otherwise harm themselves or others, it is important to contact law enforcement to ensure that the individual is safe and receives the help they need. 

As a community it is all our responsibility. We encourage all Efforia members to keep our community safe and healthy by referring questionable and objectionable content. We will use any data collected (including IP address and latitude longitude information, when available) to aid local law enforcement. Even online, law enforcement can provide support and resources to those in need, and they can also investigate any potential criminal activity. By referring hate speech and suicidality to law enforcement, we can help ensure that these issues are taken seriously and that those affected receive the help they need.

We will not share your data with any third parties beyond challenge sponsors, authors, and associated products and services for their own marketing purposes, unless you specifically provide approval to do so.

We take the security of your data seriously. We use industry-standard security measures to protect your data, including encryption, firewalls, and access controls. We also regularly review our security measures to ensure that your data is kept secure.

5. Your Rights as a Data Subject

Efforia grants all the rights to you required of the General Data Protection Regulation (GDPR) and US certification process of Privacy Shield. Under these regulations, you have certain rights as a data subject. 

Access. Efforia is about making your data more useful in helping you decide what efforts are worth continuing, and what are not. It is part of our direct mission to make your data more understandable and accessible. From a regulatory perspective, under the General Data Protection Regulation (GDPR), you have the right to access the personal information that Efforia holds about you, beyond the graphs and assessments we provide. Logged in Efforia users may go to their account settings and request a download of all data collected on them, across all challenges at any time. It will be provided within normal processing times (immediate to up to 4 hours) in a CSV format for download.

Rectification. Individuals have the right to request that their personal data be corrected if it is inaccurate or incomplete. With Efforia you may go to your account settings and make any changes at any time. The updates will be made immediately. 

Due to the nature of challenges, once data has been submitted, you may not go back and correct the data. However, challenge data is repetitive. The next time you enter that data, you may enter it correctly. 

Erasure. Individuals also have the right to request that their personal data be erased. This is known as the “right to be forgotten” and it applies when the personal data is no longer necessary for the purpose for which it was collected, or if the individual withdraws their consent for the processing of the data. Companies must comply with these requests unless they have a legitimate reason to retain the data.

Informed on how your data is used. Efforia commits to making it clear how and where your data is going to be used. Your data, with your expressed permission, may be shared with third parties to provide you the best service. These services include credit card processors, shipping providers and product fulfillment, and product service organizations. Each of these organizations may have their own privacy policies that you should review. You may review the list of services we use to process your data in your account settings. 

Right to Object to Processing. You have the right to control your data and how it is used with third parties. You have the right to object to the processing of your personal data. 

This also means that you can request that your personal data not be used for certain purposes, such as direct marketing. Efforia does not share e-mail addresses, telephone numbers or other material externally except with specific consent from you. In your account settings, you may change your mind about who your data is shared with at any time.
